If you have or had since 2008 a cellular service contract with AT&T that included an unlimited data plan and you have been throttled, you are elligible to assign your claim. You must be the account holder to assign your claim.

AT&T has been throttling the speeds of its unlimited plan users when they reach a certain amount of data used every month. AT&T states that as a result of the its network management process, customers on a 3G or 4G smartphone with an unlimited data plan who have exceeded 3 gigabytes of data in a billing period will experience reduced speeds when using data services. Customers on a 4G LTE smartphone will experience reduced speeds once their usage in a billing cycle exceeds 5 gigabytes of data.

Customers who get throttled experience speeds less than one tenth of the speeds they would otherwise be getting. As a result, customers phones are crippled to do many of the ordinary tasks that they expect. Customers who approach the limit will receive a message from AT&T the first month notifying them that they will be throttled, but will not receive any notice for future months of throttling.
